These Terms and Conditions ("Terms") govern your access to and use of the MisterPilot application programming interface, dashboard, and related services (collectively, the "Service") operated by MisterPilot ("Company", "we", "us", or "our"). By creating an account, generating an API key, or otherwise using the Service, you ("you", "your", or "Customer") agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and capable of entering into a legally binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. Your continued use of the Service constitutes ongoing acceptance of these Terms as they may be updated from time to time.
3.1 You must provide accurate and complete information when registering and keep it current.
3.2 Your API Key is confidential. You are solely responsible for safeguarding it and for all activity that occurs under your account or API Key, whether or not authorized by you.
3.3 You must notify us immediately at support@misterpilot.online if you suspect unauthorized use of your API Key. We are not liable for any loss arising from unauthorized use of your credentials before you notify us.
3.4 We may issue, rotate, or revoke API Keys where reasonably necessary for security or compliance.
4.1 The Service provides programmatic access to LLM capabilities on a usage-metered basis.
4.2 The Service relies on one or more Upstream Providers. Availability, behavior, and capabilities of the models may change when an Upstream Provider modifies, deprecates, or discontinues a model, and we may substitute models with comparable alternatives without prior notice.
4.3 We do not guarantee that Output will be accurate, complete, reliable, lawful, or fit for any particular purpose. LLM Output may contain errors or "hallucinations". You are responsible for evaluating and verifying Output before relying on it.
5.1 Prepaid model. The Service operates on a prepaid basis. You recharge your account to add Credits, and Credits are debited as you consume the Service according to our then-current pricing.
5.2 Pricing. Current pricing and per-unit consumption rates are published on the Service and may be updated from time to time. Changes apply to consumption occurring after the change takes effect. Continued use after a pricing change constitutes acceptance.
5.3 Non-refundable. Credits, once consumed, are non-refundable. Unused Credit balances are non-refundable except where a refund is required under applicable law. See Section 6 for the refund and cancellation policy.
5.4 No expiry. Credits do not expire. Your Credit balance remains available for as long as your account is active.
5.5 No interest; not a deposit. Credits represent prepaid consideration for future use of the Service. They are not a deposit, do not bear interest, and have no monetary value outside the Service.
5.6 Negative balance. If usage exceeds your available Credits due to a billing delay or technical reason, you agree to settle the shortfall, and we may suspend access until the balance is positive.
6.1 Payment processor. Payments are processed by Razorpay. By recharging, you also agree to Razorpay's applicable terms. We do not store your full card or banking details; those are handled by the payment processor.
6.2 Taxes. All prices are exclusive of applicable taxes unless stated otherwise. You are responsible for all applicable taxes, including GST, and we will charge such taxes where required.
6.3 Refund and cancellation policy. Consumed Credits are non-refundable. For unused Credits, refunds will only be made where required by applicable law or at our sole discretion in cases of duplicate charges, failed transactions where Credits were not delivered, or proven billing errors. Approved refunds are processed to the original payment method via Razorpay within 5 business days. To request a refund, contact support@misterpilot.online with your transaction details.
6.4 Failed or disputed transactions. If a recharge fails after a debit, the amount is typically auto-reversed by the payment processor per its timelines. Contact us if a debited recharge is not reflected as Credits within 24 hours.

We may investigate suspected violations and cooperate with law enforcement. Violation may result in suspension or termination without refund.
We may impose rate limits, concurrency limits, or other usage controls to maintain Service quality and may adjust them at our discretion. Sustained or abnormal usage patterns that threaten Service stability may be throttled or suspended.
9.1 Ownership. As between you and us, you retain ownership of your Input. Subject to applicable law and the limitations below, you may use the Output you generate.
9.2 License to operate. You grant us a limited license to process your Input and Output solely as needed to provide, secure, and support the Service.
9.3 Upstream Provider processing. Input and Output are transmitted to and processed by Upstream Providers to deliver the Service. How that data is handled — including whether it is retained, logged, or used to improve models — is governed by the applicable Upstream Provider's terms and policies, which are outside our control. You are responsible for reviewing those policies and for ensuring you have the right to send your Input to such providers.
9.4 Sensitive data. You should not submit Input containing personal, confidential, health, financial, or other sensitive data unless you have confirmed that doing so is lawful and consistent with the applicable Upstream Provider's policies.
9.5 Privacy Policy. Our handling of personal data is described in our Privacy Policy at https://platform.misterpilot.online/privacy-policy, which forms part of these Terms.
10.1 The Service, including its software, dashboard, documentation, and branding, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms.
10.2 Output may be non-unique; identical or similar Output may be generated for other users. We make no claim of ownership over your Output but make no warranty that Output does not infringe third-party rights.
10.3 You may not use our name, logo, or marks without prior written permission.
The Service depends on Upstream Providers and the payment processor. We are not responsible for the acts, omissions, availability, or policies of any third party. Disruptions, changes, or discontinuation by a third party may affect the Service, and we are not liable for resulting impact.
12.1 The Service is provided on an "as is" and "as available" basis. We do not warrant uninterrupted, error-free, or secure operation, nor any particular uptime unless agreed separately in writing.
12.2 To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
13.1 To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to the Service or these Terms.
13.2 Our total aggregate liability arising out of or related to the Service will not exceed the total amount you paid us for Credits in the 6-month period immediately preceding the event giving rise to the claim.
13.3 These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages. Nothing limits liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless the Company and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Input, your Output, your use of the Service, or your breach of these Terms or applicable law.
15.1 We may suspend or terminate your access immediately if you breach these Terms, if required by law, or to protect the Service or other users.
15.2 You may stop using the Service at any time. Termination does not entitle you to a refund of Credits except as set out in Section 6.
15.3 Upon termination, your right to use the Service ceases and your API Keys may be revoked. Sections that by their nature should survive (including IP, disclaimers, liability limits, and indemnity) survive termination.
We may modify these Terms from time to time. The updated version takes effect when posted with a revised "Last updated" date, unless a longer notice period is required by law. Material changes may be notified via the Service or by email. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of India. Subject to any applicable consumer protection rights, the courts at Shimla, Himachal Pradesh, India will have exclusive jurisdiction.

We will acknowledge complaints within 24 hours and endeavor to resolve them within the timelines prescribed by law.
19.1 Entire agreement. These Terms, together with the Privacy Policy and any pricing pages, constitute the entire agreement between you and us regarding the Service.
19.2 Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
19.3 No waiver. Our failure to enforce any right is not a waiver of that right.
19.4 Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
19.5 Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
